Georgia employment lawyer’s alert- Former account manager filed a lawsuit against United Parcel Service for denying overtime wages.

Atlanta, GA–The world’s largest package delivery company, United Parcel Service Inc. (UPS), is named in a lawsuit filed on Wednesday, August 19, 2009, by a former employee of the mailing company. The former employee claims UPS has withheld overtime pay from their account managers, as reported by Reuters.

The employment lawsuit was filed in the San Diego federal court, and is asking for more than $100 million of unpaid overtime, interest, and statutory penalties. The lawsuit is seeking class action status. The former employee, Laura Meza, was reportedly a UPS account manager for the last year-and-a-half. Meza claims UPS violated the U.S. Fair Labor Standards Act by not paying their employees overtime wages. The lawsuit alleges UPS account managers usually work 60 hour weeks are denied overtime payment for their work in excess of 40 hours a week. In addition, UPS neglected to maintain accurate records of the hour’s employees worked and failed to provide meal and rest breaks. UPS has reportedly has not received the lawsuit at this time, but a UPS official’s stated, “There is a defined sales compensation structure and we believe these employees are classified as exempt and not subject to over time.”
