Sex offenders seek right to social media access

U.S. – A number of registered sex offenders are purportedly making attempts to legally challenge bans that prohibit their use of Facebook and other social media websites. As reported by the Associated Press (AP), some have been successful in obtaining favorable rulings in court cases where the claim is made that such restrictions violate their right to free speech.

As noted in the report, the issues surrounding the placement of restrictions on the use of social media sites present relatively new challenges for states, which are already allowed to restrict where convicted sex offenders can work or live following their completion of a related jail sentence.

Carolyn Atwell-Davis, director of legislative affairs at the National Center for Missing & Exploited Children in Virginia is quoted by the AP as stating of the legal battles, “It’s going to be really, really hard, I think, to write something that will achieve the state’s purpose in protecting children online but not be restrictive enough to be unconstitutional.”
