Delaware, Ohio – A Delaware County judge threw out charges against former Ohio State football player Jim Stillwagon citing a lack of evidence to continue in the road-rage case. As reported by The Columbus Dispatch, Delaware Common Pleas Judge Duncan Whitney dismissed three remaining counts of felonious assault on Friday, which was the third day of his trial.

Stillwagon, 64, was previously charged in connection with a shooting last year in which Richard Mattingly accused him of following him to a parking lot and hitting him in the head with the butt of his gun, which purportedly discharged causing him injury.

Attorneys for Stillwagon alleged he shot Mattingly in self-defense after he used his truck as a weapon.

Mattingly has filed a civil suit against Stillwagon this month for damages for medical expenses.
