Los Angeles – A judge has vacated the 124-year prison sentence of Max Factor heir Andrew Luster. As reported by Reuters, Ventura County Superior Court Judge Kathryne Stoltz ruled Monday that sentencing for Luster, who was convicted in 2003 of rape and related crimes, was improperly imposed.

Luster is the grandson of the late founder of the cosmetics company, Max Factor & Company, Max Factor. He was sentenced in absentia and captured months later after he fled to Mexico while his trial was being held.

Stoltz also denied Luster a new trial in her decision Monday, rejecting arguments by his current attorneys that his original attorneys failed to provide him with an adequate defense.

A new sentencing hearing is expected to be held in accordance with the judge’s ruling.
