New Jersey – The Wal-mart truck driver who was charged in connection with a fatal truck crash that injured actor and comedian Tracy Morgan is seeking a delay in Morgan’s lawsuit. As reported by NBC Philadelphia news, the attorney of driver Kevin Roper has filed a request that the federal suit be delayed as his state criminal case moves forward.

Attorney David Glassman is quoted as stating in the filing that allowing the federal suit to proceed in federal court as the state case is ongoing would violate Roper’s constitutional rights “because it would provide a de facto additional forum through which the criminal prosecution could obtain evidence for use in the criminal trial against Roper.”

As noted in the report, Roper has pleaded not guilty to charges of death by auto and assault by auto in the crash, which occurred in June. Morgan and two other people sustained serious injuries in the accident, and one person was killed.

Morgan has filed a lawsuit against Wal-mart seeking compensatory and punitive damages.
