New York – A grand jury is set to be referred the case involving NASCAR racer Tony Stewart, regarding a fatal dirt track race. As reported by Reuters, prosecutors stated on Thursday that the racing champion’s case would be sent to the grand jury for a determination about appropriate action in the case.

The case involves an incident in which Stewart struck and killed a man at Canandaigua Motorsports Park during a sprint race that was unrelated to NASCAR. A video of the Aug. 9 incident went viral.

Ontario County District Attorney Michael Tantillo is quoted as stating of the matter, “I have made the determination that it would be appropriate to submit the evidence to a grand jury, for their determination as to what action should be taken in this matter.”

Stewart, 43, said of the case in a statement, “I look forward to this process being completed, and I will continue to provide my full cooperation.”
