Baton Rouge, La – The amount awarded by a jury to the family of a Louisiana man who died after sustaining injuries in a police car crash has been reduced by half. As reported by the Associated Press (AP), a state appellate court decreased the $1 million award to $500,000, ruling the amount is the highest required under state law to be paid by a state or political subdivision for personal injury damages to one injured person.

The case stems from a 2008 car accident, which resulted in the death of Nelson Dakmak Sr. A jury awarded Dakmak’s family $1 million in 2011, after deeming Baton Rouge police Lt. Stephen C. Tibbetts to be liable for the crash. Dakmak, who filed the lawsuit while in hospice care, sustained severe injuries to his spine and died approximately three months after the accident.

Dakmak’s three sons were also awarded $30,000 in damages, which the Court of Appeal ruled the Police Department remains liable for.
