Chicago – Attorneys for a Millennium Park restaurant being sued by the city say former Mayor Richard M. Daley should disclose details about his medical condition that should purportedly prevent him from testifying in the case. As reported by the Chicago Tribune, attorneys for Daley have requested that a judge throw out a subpoena compelling him to testify on the grounds of medical hardship.

The recent motion was filed by Park Grill lawyers on Friday. The motion is quoted as stating that “it was Daley himself who raised the issue of his medical condition in this case, and he does so in an effort to obtain affirmative relief from the court — i.e., to be excused from testifying at trial.”

It goes on to assert, “In this way, Daley is like a personal injury plaintiff who injects his or her medical condition into a case in order to obtain relief from the court, and thereby waives any claims of confidentiality or privilege related to that medical information.”

The owners of the Park Grill were sued by the city in 2011, over allegations that the contract to run the restaurant was not valid.
