Lawsuit filed against Florida health department over septic tank permits

Florida – A lawsuit has been filed by two attorneys on behalf of an eco tour business owner against the Health Department of Florida. As reported by The Daytona Beach News-Journal, the suit is seeking to put a stop to septic tanks being permitted n counties along the Indian River Lagoon system.

Orlando attorney Christopher Byrd is quoted in the report as stating after the intent to sue notice was filed on Thursday, “We hope the Department of Health stops permitting septic tanks in the Indian River Lagoon drainage basin area and in soils that aren’t suited well for treatment of septic tank waste.”

Byrd is further quoted as stating, “We’ve got to stop permitting them (the tanks) and then we’ve got to abate the pollution… We need to stop this barbaric practice of sending human waste to the Lagoon.”

The case was brought forth in accordance with the Endangered Species Act.
