NY court says Starbucks baristas must share tips

New York – New York’s highest court has determined that baristas of the popular coffee chain Starbucks must share their tips. As reported by the Associated Press (AP), the Court of Appeals ruled that shift supervisors get to share in tips given to coffee servers because they perform much of the same work. The court also determined that the tip share can be denied to assistant managers.

The ruling was made in response to two lawsuits for which it determined that the policy of Starbucks in dividing the tips was consistent with labor law.

New York State Restaurant Association president Rick Sampson is quoted by the AP as stating of the ruling, “In this business, many staff members share all kinds of responsibilities, and now we have an understanding of who can participate in the tip pool.”
