Denver – The suspect in the 2012 fatal Colorado theater shootings is expected to use an insanity defense. As reported by the Associated Press (AP), James Holmes, who has been charged with multiple counts of murder and attempted murder after an assault that led to the deaths of 12 people and injuries of several others will purportedly change his plea to not guilty by reason of insanity.

Prosecutors in the case previously stated they would be seeking the death penalty. Holmes’ attorneys reportedly put off the insanity plea asserting there was an overlap in state laws regarding the death penalty and insanity that may impact his defense.

If the plea is accepted by the judge, Holmes will undergo an evaluation at the state mental hospital. Holmes was reportedly seen by a psychiatrist prior to the attack.
