Santa Fe – A drunk driver has filed a lawsuit against his friend and the restaurants that served him alcohol in connection with a 2010 crash that killed two teens. As reported by the ABQ Journal, James Ruiz, who was convicted in the drunk driving killing of Del Lynn Peshlakai, 19, and her sister Deshauna, 17, is alleging that Applebee’s and the Blue Corn Café as well as his friend Gilbert Mendoza caused him to suffer emotional distress.

Ruiz is seeking monetary damages claiming the actions of the restaurants in serving him alcohol and Mendoza in allowing him to drive while intoxicated led to his being involved in the fatal accident and convicted of related crimes. He is currently serving a 40-year sentence after pleading guilty in 2011.

A spokesperson for Santa Fe Dining, a restaurant group that includes the Blue Corn, is quoted in the report as stating, “Our attorney has not had an opportunity to review the complaint handwritten and filed by Mr. Ruiz. Consequently it is not possible to comment, except to express the continued, deepest sympathy to the family of the young women killed by Mr. Ruiz, an individual who has long history of criminal DWI behavior.”
