Uncertainty looms in transgender divorce case

Phoenix, Arizona – A divorce case involving a man who underwent a sex change operation has hit a legal snag. As reported by the Associated Press (AP), the case of Thomas and Nancy Beatie has been stalled as a judge seeks to determine whether the union is recognizable under Arizona law, due to the state’s ban on same-sex marriage.

Thomas Beatie gained national attention after giving birth to three children following his sex-change operation, in which he retained female reproductive organs.

Maricopa County Family Court Judge Douglas Gerlach is quoted by the AP as stating in June of being unable to find legal authority to recognize the union as being between a man and a woman, “Are we dealing with a same-sex marriage?”

In the event that the judge rules he does not have jurisdiction in the case, the couple may have to resort to civil court to divide their assets.

A trial is set for January 31.
