Sacramento, California (Associated Press) – A federal judge overturned California’s three-year-old assault weapons ban, ruling that it violated the right to bear weapons under the Constitution.
San Diego District Judge Roger Benitez ruled on Friday that the state’s definition of illegal military rifles illegally deprived law-abiding Californians of weapons normally allowed in most other states.
California first restricted offensive weapons in 1989, and the law has since been updated many times.
The California Attorney General argued that assault weapons defined by the law are more dangerous than other guns and are used disproportionately in crime and mass shootings. But Benitez said that the vast majority of guns are owned for legitimate purposes.
