Southwestern Law School, Los Angeles, California, Oct. 26, 2022 (GLOBE NEWSWIRE) — Southwestern Law School celebrated Constitution Day 2022 by gathering to hear Dean Erwin Chemerinsky’s compelling analysis of constitutional originalism, the view that the meaning of the US Constitution is fixed, and why he considers this kind of constitutional interpretation undesirable and dangerous. During the presentation, which focused on his new book, Worse Than Nothing: The Dangerous Fallacy of Originalismpublished by Yale University Press in September 2022, Dean Chemerinsky illustrated how the Supreme Court is poised to overturn a long-held precedent.

Dean Chemerinsky challenged the original premise that the only fundamental rights are those contained in the original text of the Constitution, or in their original meaning. According to an original reading of the Constitution, rights considered by many to be fundamental to American life, including the right to marry, reproduce, purchase birth control, and refuse life-saving medical treatment, cannot be justified because they are not contained in the literal text of the Constitution Constitution are included. Accordingly, they are all in danger.

One of the most thought-provoking sections of Dean Chemerinsky’s lecture took place when he described originalism’s main flaw: evaluating contemporary problems on the basis of a document prepared in the context of an agricultural slave society and the standards of the late 18th century.

During the question-and-answer session, a student asked Dean Chemerinsky if he had any predictions for the Supreme Court’s decisions this semester. Dean Chemerinsky expressed most concern about the result Moore vs. Harper.
