Oct. 18, 2022 (GLOBE NEWSWIRE) — Today, the New Civil Liberties Alliance, a nonpartisan, nonprofit civil rights group, submitted a motion legal action on behalf of his client, the Cato Institute, asked the US District Court for the District of Kansas to stop the Biden administration Student Loan Debt Waiver Plan. The NCLA’s complaint argues that the US Department of Education’s unilateral plan to cancel student loan debt is not supported by any legitimate claim by legal authority and effectively negates a significant competitive advantage in attracting and retaining talented borrower employees from nonprofit organizations, thereby the elementary school becomes frustrated Purpose of the already existing PSLF (Public Service Loan Forgiveness) program.
The Cato Institute is a nonprofit organization that promotes individual liberty, limited government, free markets, and peaceful international relations. Like other nonprofits, including the ACLU and NCLA, it attracts and retains talented employees who have student loans with incentives enacted by Congress through the PSLF program. Among other things, the PSLF program allows student loan borrowers to waive their outstanding balances after serving at least ten years with a qualifying nonprofit organization. The meticulous and rigorous debt relief criteria available under the PSLF program undermines any claim that Congress has authorized the Secretary of Education to arbitrarily cancel debt without requiring borrowers to meet such rigorous criteria.
The government is trying to justify debt relief with the Higher Education Relief Opportunities for Students (HEROES) Act of 2003, which was passed after the September 11 terrorist attacks to help soldiers responding to threats to national security. This law in no way entitles you to a blanket waiver of student debt.
