Spanish court sentences Shakira to tax fraud trial

A Spanish court has sentenced Colombian music superstar Shakira to a yet-to-be-determined trial in a tax fraud case, court documents showed on Tuesday.

Prosecutors in Barcelona said in July they would seek more than eight years in prison and a fine of almost 24 million euros ($24 million) against the singer after she turned down a plea deal over allegations of tax evasion.

They accuse the 45-year-old “Hips don’t Lie” singer of having defrauded the Spanish tax office of 14.5 million euros in income from the years 2012 to 2014.

Prosecutors say Shakira moved to Spain in 2011 when her relationship with FC Barcelona defender Gerard Pique became public, but maintained her official tax residency in the Bahamas until 2015.

The couple, who have two children, announced their split in June.

On September 19, a Barcelona court ordered the singer to stand trial for six tax offenses, according to a court ruling released on Tuesday.

In an interview published in Elle magazine last week, Shakira said she was confident she did the right thing and owed nothing to the Spanish tax authorities.

“These allegations are false,” she said.

“While Gerard and I were together I was on a world tour. I’ve spent more than 240 days outside of Spain, so there was no way I could qualify as a resident,” she added.

“The Spanish tax authorities saw that I was dating a Spanish citizen and started drooling. It’s clear they wanted to be after that money no matter what.”

Shakira’s lawyers said that until 2014 she made most of her money from international tours, only moved to Spain full-time in 2015 and had settled all her tax obligations.

The singer says she paid 17.2 million euros to the Spanish tax authorities and has no outstanding debt.

She argues that Spanish prosecutors are trying to recover money she made during her international tour and by appearing on the show The Voice. She was a judge on the show in the United States when she says she wasn’t based in Spain yet.

A court in Barcelona in May rejected an appeal by the singer to have the charges dropped.

Shakira was named in October 2021 in one of the largest leaked financial documents known as the “Pandora Papers” among public figures linked to offshore assets.
