Elon Musk’s Tesla counters the California agency in racism

Tesla Inc. TSLA filed a counterclaim Thursday against the California Department of Civil Rights lawsuit alleging racial discrimination and harassment at the company between 2015 and 2019.

What happened: After receiving hundreds of complaints from workers, the state agency then known as the California Department of Fair Employment and Housing filed a complaint against Tesla in Alameda County Superior Court on Feb. 9, the agency announced in a Feb. 16 press release.

“In the lawsuit, DFEH alleged that black workers at Tesla suffered discrimination, harassment and/or retaliation because of their race,” it said. Tesla called DFEH in a blog post at the time about its “misguided lawsuit.”

Why it matters: In which Counterclaim filed On Thursday, Tesla said the CRD failed to adequately share the details of its alleged discriminatory behavior, nor conduct a fair and impartial investigation.

“The finding is totally inconsistent with the principles of fair notice, impartial investigation, good faith arbitration and mandatory pre-trial arbitration embodied in the FEHA,” the electric vehicle maker said.

“The public interest demands that CRD be held accountable for its illegal rulemaking in violation of the APA,” it added.

By the way, Tesla was ordered to pay $137 million in damages to a former black contractor named Owen Diaz, who accused the company of ignoring discrimination and racial abuse at the same plant.
