VANCOUVER, British Columbia, Sept. 20, 2022 (GLOBE NEWSWIRE) — Representative plaintiffs in the Band Reparations class action, shíshálh Nation and Tk’emlúps te Secwépemc, today announced the adjournment of the Band Reparations litigation to allow for its conclusion Settlement talks with Canada. Canada and the representative plaintiffs are currently finalizing the details of a settlement agreement that would resolve the Band class claims. The class action lawsuit concerns the collective harm suffered by Indigenous communities as a result of Canada’s role in India’s boarding school system.

Because this is a class action, any proposed settlement agreement will not be completed until approved by the federal court after a settlement approval hearing, which will not be heard for several months.

The next steps are as follows:

  • In the coming weeks, Canada and representative plaintiffs will conduct further negotiations on the terms of a proposed settlement agreement.
  • If a proposed settlement agreement is reached, representative plaintiffs will notify all 326 group members and the public of the full details of the proposed settlement agreement.
  • If a proposed settlement agreement is executed, the federal court will hold a settlement approval hearing to determine whether the proposed settlement agreement is fair, reasonable and in the best interests of the Group. At the settlement approval hearing, members of the 326-band class will have an opportunity to voice their views on the proposed settlement.
