YOU ARE HEREBY NOTIFIED that pursuant to an Order of the U.S. District Court for the Eastern District of Texas, a hearing will be held on November 30, 2022 at 9:00 a.m. before the Honorable Sean D. Jordan, District Judge of the Eastern District of Texas, 7940 Preston Road, Suite 111, Plano, TX 75024 for the purpose of determining: (1) whether the proposed settlement of claims in the above action for consideration including the sum of $3,250,000 should be deemed fair by the court , reasonably and appropriately approved; (2) whether the proposed settlement proceeds distribution plan is fair, reasonable and reasonable; (3) whether the Lead Counsel’s request for attorneys’ fees of up to one-third of the Settlement Amount ($1,083,333.33) plus a proportionate share of the interest accrued on the Settlement Amount, reimbursement by the Lead Counsel of incurred legal costs of no more than $50,000 and the award to Lead Plaintiff of not more than $5,000 should be approved; and (4) whether the Complaint should be dismissed with prejudice as set forth in the Revised Agreement and Settlement Agreement dated June 1, 2022 (the “Agreement”).
