Attorneys in the Capital One data breach settlement will ask for up to $66.5 million in attorney fees, one of the largest requests in a cybersecurity case.
The fee request is 35% of the $190 million settlement, which is one of the largest data breach agreements to date. On Dec. 20, Capital One confirmed the settlement, and the amount, which would compensate 98 million customers impacted by the 2019 breach. But on Monday, lawyers filed a motion for preliminary approval that provides more details about the agreement, which also would pay for service awards to class representatives, a “state-of-the-art” notice program, and attorney fees.
