Dallas, TX – Two Dallas personal injury attorneys with the Eberstein Witherite LLP law firm were recently profiled by verdict and settlement research provider VerdictSearch for a case win involving a plaintiff injured by a speeding driver accused of talking on their cell phone and causing a serious accident. The plaintiff was represented by attorneys Zach Herbert and Victor Rodriguez, both decorated lawyers of the firm who have helped numerous Dallas accident injury victims obtain equitable compensation for damages imposed on their clients by the negligence or wrongful actions of others.

The plaintiff in the case was traveling in a pickup truck when he became involved in a collision with the defendant on Lovers Lane near the intersection of Westchester Drive in Dallas in 2013. According to court records, the impact of the accident led to the plaintiff undergoing six months of chiropractic treatment for reported cervical, lumbar, and wrist strains. Jurors awarded the plaintiff $138,504 in expenses which included medical costs and pain and suffering. The trial lasted two days.

Cell Phone Distractions and Serious Motor Vehicle Accidents

Cell phones are stated to be one of the most common driving distractions because an overwhelming number of drivers use mobile devices for extended periods of time daily. According to the National Safety Council, an estimated one in four car crashes involves cell phone use.

A USA TODAY report says that the statistic amounts to approximately 26 percent of all car accidents in the country.

“The National Safety Council's annual injury and fatality report, "Injury Facts," found that the use of cellphones causes 26% of the nation's car accidents, a modest increase from the previous year. The 2014 edition of the report compares data from 2013 and earlier.

Only 5% of cellphone-related crashes occur because the driver is texting. The majority of the accidents involve drivers distracted while talking on handheld or hands-free cellphones.”

As the aforementioned case illustrates, those whose actions of talking on or using a cell phone while driving lead to a serious accident may find themselves being taken to court over the matter. A number of states in the U.S. ban cell phone use while driving to some capacity. In 14 states, all drivers are prohibited from using hand-held mobile devices while driving. There are 46 states that currently ban text messaging for all drivers. Therefore in addition to civil action being brought against drivers whose use of a mobile device while driving led to an accident, criminal penalties may also be imposed against those found to be in violation of related laws.
