Fall has started and winter will soon be here. Rand says winter is hazardous for pedestrians because weather plays a big role in creating unsafe conditions that can result in a fall. “Winter is especially dangerous. Ice, snow, unshoveled sidewalks. That’s a very big part of it,” Rand says. Other contributing factors to falls on sidewalks could be that it’s uneven and broken up by tree roots.

He says that in his experience many fall victims don’t get medical attention quickly enough. “A lot of people don’t want to go to the doctor, especially in this day and age because of the expense,” Rand says, despite the fact many fall injuries could be very serious.

“They could have a tear in their shoulder, a tear in their knee and end up with a fracture,” he says, “When you fall it really could create a long term problem. That’s why it’s important to go to the hospital, get prompt medical care, find out what’s wrong so the doctors can really help you and it doesn’t have to linger any longer than it has to.”

Rand says these types of cases are similar to other negligence cases in that doing an investigation and finding the facts are critical. “We like to get photos. We want to see exactly what happened. We look at all the client’s medical records,” he says, “If it doesn’t settle we file a lawsuit, proceed to a hearing, have the client testify about their fall, their damages, their injuries and how it affected their life.” Possible defendants could be property owners, property managers, tenants or government entities.

Because it can be difficult to prove liability in a slip and fall case Rand says he needs help from clients. “Proving the defect and that it was the source of the fall is a challenge but something we need to do to prevail and recover money damages. That’s why it’s so important to take prompt action. Take a photograph, take some pictures with your cell phone,” Rand advises, “Preservation of evidence is so important in slip and fall accidents.”

Slip and fall victims need to take quick action for several reasons, including,

·       Video surveillance images may show your fall and be obtained from the police or private businesses near the scene of the accident, but they may be erased if a request for them comes too late.

·       The state or a municipality may have played a role in creating the unsafe condition. While injury lawsuits can normally be filed within two years of the accident, a notice of claim to a government entity must be filed within six months in Pennsylvania and ninety days in New Jersey.
