Washington – The Supreme Court has agreed to review an appeal by Tyson Foods Inc. over a class action lawsuit filed against the company over worker pay. According to an Associated Press report, the high court agreed to weigh issues concerning a $5.8 million judgement against the company over the pay of thousands of workers at a pork processing plant in Storm Lake, Iowa.

Tyson alleges that it should not have been forced to defend a class action lawsuit alleging it failed to pay certain employees for time they spent putting on and removing protective clothing and equipment required for their jobs.

As noted in the report, a federal appeals court in St. Louis ruled in favor of the employees. Tyson asserted that the lower courts’ method in determining the damages for the entire class should not have been allowed. The company also says that many members included in the class were not injured.

The Supreme Court is set to hear the case when it begins its new term this fall.
