The driver in the crash, which left Morgan with critical injuries, and resulted in the death of another comedian, has since been charged with vehicular homicide and assault by auto. He has pleaded not guilty to the charges, a move Fadduol, Cluff & Hardy attorneys say many truck drivers do in an effort to avoid liability.

According to the Albuquerque big rig accident lawyers of Fadduol, Cluff & Hardy, Morgan’s decision to file a suit against Walmart was a step many of those who have been injured in a similar type of accident should consider taking. Particularly in cases where gross negligence or misconduct on the part of a truck driver was involved. Like Morgan, accident victims in these cases typically have to undergo intensive medical treatment or prolonged rehabilitative care. These are expenses that drivers or companies responsible for an accident should bear, not the victims. Also, as illustrated by the truck driver’s plea in the Morgan case, because many truck drivers refuse to take initial responsibility even if there is overwhelming evidence supporting that they are at fault for an accident, filing a civil suit is often the only means that victims can get just compensation for damages they have incurred.
