In a typical qui tam action based on a state’s qui tam law, an individual sues an entity in the name of the government for committing fraud on that government. After evaluating the claims, the state may join in and take over the primary responsibility for prosecuting the case. If the litigation is resolved favorably for the government, the whistleblower receives a portion of the government’s recovery for the whistleblower’s role in exposing the fraud.
