Qui Tam Attorneys Discuss State Qui Tam Laws
03/06/2012 // San Francisco, CA, USA // Whistleblower Law Firm (Press Release) // Jeffrey Keller // (press release)
Attorneys at the whistleblower law firm Keller Grover LLP handle qui tam actions for whistleblowers. Often these actions are brought under the federal False Claims Act. Federal False Claims Act cases occur when a wrongdoer commits fraud against the United States government and a whistleblower seeks to expose the fraud and help prevent future frauds. Because of the significant role whistleblowers play in these cases, they are entitled by law to recover a reward in the process.
But, as the whistleblower lawyers at Keller Grover LLP point out, not all fraud is committed against the federal government. To that end, many, but not all, states have enacted their own qui tam laws. These qui tam laws are designed to protect state governments, and in some cases, local governments, from fraud. They also provide financial incentives to whistleblowers to encourage whistleblowers to come forward with allegations of fraudulent conduct. Many of these laws are modeled on the federal False Claims Act, although each law is unique. For example, a qui tam law may apply only to cases involving healthcare fraud.
In a typical qui tam action based on a state’s qui tam law, an individual sues an entity in the name of the government for committing fraud on that government. After evaluating the claims, the state may join in and take over the primary responsibility for prosecuting the case. If the litigation is resolved favorably for the government, the whistleblower receives a portion of the government’s recovery for the whistleblower’s role in exposing the fraud.
