Albuquerque Attorney Ron Bell has seen recent court rulings in New Jersey and Texas that states that texting a person you know to be driving can make the texting party legally liable for a crash if they are on the other end of the phone at the time of your accident. The judges maintain that texting is akin to creating a distraction to the driver and that can cause an accuident.

Obvious concerns include: How do I know when someone is driving? Will there be laws passed to tell us when we can text? How can I prevent someone from texting me? Don’t forget the obvious answers–the driver is ultimately in control and their good judgement will always prevail when dealing with any risky situiations. This is another reason to be sure that your friends and family are aware that there may be future cases tried and won against people not in the vehicle but held liable for causing an accident.
