Albany, New York – The family of a woman killed in a fatal accident is suing the Department of Transportation, alleging that the state transportation engineer who purportedly caused the wreck was intoxicated while driving a state vehicle. As reported by the Associated Press (AP), the lawsuit filed by the estate of Nancy McQueeny asserts that the employers of 79-year-old Wendell Strum, who was also killed in the vehicle accident, had knowledge of Strum’s history of drinking while on the job.

As noted in the report, toxicology reports indicted Strum was legally intoxicated at the time of the accident. His vehicle hit McQueeny’s after crossing into an oncoming lane.

James Gleason, an attorney with the law firm representing the family of McQueeny, is quoted by the AP as stating, “It is disconcerting that a state employee is intoxicated in the middle of the afternoon, driving a state vehicle.”

Strum had reportedly been employed by the Department of Transportation for 57 years.
