Buffalo, NY — The YMCA is facing a lawsuit after an 11-year-old girl gave birth and contracted a sexually transmitted disease, after being raped in a sauna by a summer counselor at an upstate New York YMCA, reported New York Daily News.

The lawsuit, which was filed in the state Supreme Court, stated that the victim, now 12, was raped in the sauna of the William-Emslie YMCA in Buffalo last July. The girl delivered a baby boy earlier this year.

According to the civil lawsuit, YMCA officials did not alert police about the rape, they only fired the 17-year-old counselor after discovering what had took place.

In addition, the lawsuit accuses YMCA of negligence because a co-worker, who was working as a lifeguard at the time, allegedly witnessed the sexual assault.

The plaintiff’s attorney stated that the lifeguard reported the incident to management, who did not report it to police.

The YMCA notified the victim’s parents that an incident had taken place, but failed to tell them that the nature of the incident was sexual, the lawsuit stated.
