Consumer Product Safety Commission alerts product liability lawyers-A toy dart gun set imported by OKK Trading was recalled.

Los Angeles, CA—OKK Trading Inc., of Los Angeles, California, and the U.S. Consumer Product Safety Commission (CPSC) http://www.cpsc.gov/, announced a voluntary recall of the “Action Team” Toy Dart Gun Set due to a choking threat. The recall was announced on December 17, 2009, and advises all consumers to stop using the product unless otherwise instructed, as reported by the CPSC.

Nearly 22,000 “Action Team” Toy Gun Dart Sets, manufactured by Kong Hoi Industrial Co., of Hong Kong, China, were recalled because the toy would pose a hazard if a child were to put the soft, pliable plastic dart in their mouth. The dart is likely to choke/aspirate the child, which will impair the child’s breathing. If the dart is not immediately removed, the inability to breathe can cause brain damage or death. The recalled product has a toy gun with three soft rubber darts, a S.W.A.T. watch, a baton, walkie-talkie, a whistle, a badge, and an identification card. The darts are described as soft, pliable orange plastic darts with a 2 ½ inch long shaft and have a 3/4 inch diameter suction cup. The dart gun is black with an orange nose and trigger with a red spring release mechanism. On the side of the barrel “Made in China” is imprinted. The recalled product was sold at discount department stores nationwide from December 2006 through March 2008 for $1.

There has been one reported death of an 8-year-old Port Arthur, Texas boy in November 2007. The death occurred when the child was apparently chewing on the toy dart, when he accidentally swallowed it and it became stuck in his airway, leaving him without the ability to breathe. Consumers are urged to take the dart gun set from their children immediately and to contact OKK trading to return the toy set for a refund of $3. OKK trading is providing free postage paid envelope for consumers who returning the product.
