San Francisco, CA—A criminal grand jury indicted both the owner and foreman of a roofing company after they were found to be negligent in connection with the death of an employee in 2008. The owner and foreman were arraigned on charges of felony involuntary manslaughter and felony violation of the labor code with regard to the tragic on-the-job accident, in which a worker fell from the roof of a San Francisco apartment building, as announced by San Francisco District Attorney Kamala Harris on Monday, April 26, 2010. The grand jury also reportedly added several counts of workers’ compensation fraud to the owner’s growing list of convictions, according to information provided by the Bay City News.

Reports stated Antonio Martinez, employed as a roofer by California C&R Inc., was working along the edge of a four-story apartment complex in San Francisco, California when he fell 38 feet to his death. According to the Office of Compliance http://www.compliance.gov, fatal workplace falls, in which the victim fell from a higher level to a lower level, consisted of 87 percent of the total 696 fatal employment-related falls in 2003. Martinez reportedly lacked a safety harness and was not being supervised when the fatal work-related accident occurred.

As a result of the deadly occupational accident, the owner of California C&R Inc., Sam Hyung Goo Shim, and the company’s foreman, Jwa Young Kim, were indicted on criminal charges of felony involuntary manslaughter and felony violation of the labor code. Also, since investigatory findings revealed Shim failed to “report Martinez’s wages in payroll filings submitted to the state Compensation Insurance Fund and the Employment Development Department”, the grand jury subsequently returned charged of workers compensation fraud against Shim and his roofing business. The owner and foreman of California C&R Inc. are expected to return to court on May 10, 2010, so the case may proceed.
