The Supreme Court has ruled that deals made between pharmaceutical companies and their generic drug competition may be challenged.

06/17/2013 // West Palm Beach , Florida, US // JusticeNewsFlash // Justice News Flash // (press release)

Washington – The Supreme Court has ruled that deals made between pharmaceutical companies and generic drug makers can be illegal and subject to being challenged in court. As reported by the Associated Press (AP), the justices voted 5-3 in the decision regarding what government officials assert prevent cheaper forms of some drugs from being placed in the market.

The ruling allows government inspections and challenges to what are regarded as “pay-for-delay” deals. Also known as “reverse settlements,” these result from generic drug makers filing a challenge at the Food and Drug Administration to patents on brand-name drugs that are held by pharmaceutical companies for 20 years. Deals often result that allow the generic drug company to sell cheaper drug versions after an agreed upon time period, and include a considerable payment as part of the settlement.

Paul Bisaro, president and CEO of Actavis, is quoted by the AP as stating of the court’s decision, “Rather, the court has established that the ‘rule of reason’ be applied, and left it to the lower courts to determine if the benefits of the settlement outweigh harm to consumers…We believe this decision continues to provide for a lawful and legitimate pathway for resolving patent challenge litigation in a manner that is pro-competitive and beneficial to American consumers.”

San Francisco – A judge has not yet made a ruling in the case involving the purported exposure of thousands of inmates at two California state prisons to an airborne fungus. As reported by the Associated Press (AP), an attorney representing the inmates told U.S. District Judge Thelton Henderson Monday that the fungus presented the widespread threat of valley fever, which could prove deadly for thousands of inmates for whom he said an immediate transfer should be arranged.

Walter Schneider, an attorney representing the state Department of Corrections and Rehabilitation, stated to the contrary that a study by the U.S. Centers for Disease Control and Prevention and National Institute for Occupational Safety and Health should be allowed to be completed prior to the arrangement for an inmate transfer. The study will purportedly be completed December.

A reported 18 deaths have been linked to the fungus.

Post-traumatic headaches must be treated aggressively. Botox may be useful in refractory cases.

05/20/2013 // Concord, CA, USA // LifeCare123 // Greg Vigna, MD, JD // (press release)

Medical Perspective:

Post-traumatic headaches (PTH) occurs in 90% of patients following a traumatic brain injury (TBI) and appear to be more common and more severe in mild TBI compared to moderate and severe TBI. Over time the percentage of patients who suffer with PTH decreases but almost 25% have persisting headaches at four years. It is especially unfortunate that many patients with mild TBI appear to be fine but suffer from ongoing PTH and other postconcussion symptoms, which may be minimalized by doctors, therapist, employers, and family. It is not uncommon for PTH to be the most debilitating complaint following a mild TBI leading to missed work days, prolonged disability, and decreased community reintegration following the TBI.

Understanding the consequences of PTH is important for both families and patients to aggressively intervene with appropriate therapies to decrease resulting disability. A majority of PTH is of the tension variety and it is essential that education is an early intervention to teach the issues of how stress and fatigue can lead to an increased frequency of debilitating headaches. Physical therapy is a mainstay in PTH management with modalities including massage, cervical traction, and strengthening of the neck musculature will decrease painful muscle spasms that lead to headaches. Biofeedback can be use to help a patient better control tension in muscles that lead to headaches.

Medication management includes anti-inflammatories and tricyclic antidepressants. Unfortunately, a significant percentage of patients will have ongoing disability and pain related to PTH despite appropriate therapy as discussed above. In these patients Botox to the frontalis muscle and other pericranial muscles have been reported to significantly improve PTH. This is an off label use of the drug but has been shown to be safe and effective in selected patients with persistent PTH.

Life Care Perspective:

All necessary and appropriate future medical and future care needs related to the TBI should be included in the life care plan. All medications, physician visits, medical procedures, and other costs must be included. It has been generally accepted in medicine that safe and effective therapies that are off label uses of a particular drug are necessary and appropriate interventions if it improves the medical, physical, as well as psychosocial welfare of a patient. Botox would be included in this cost if it has proven effective in the individual patient.

The workplace accident occurred on the Newburgh-Beacon Bridge Thursday morning, June 6, 2013, the Associated Press reported.

According to officials from the New York State Bridge Authority, 46-year-old Renalto Amaral of Newark, N.J., sustained injuries while working in a containment area underneath the bridge deck.

The containment system is a plastic-enclosed device that helps keep paint chips from falling into the river below.

The nature of the accident and Amaral’s injuries were not released. This is the second accident to occur at the bride in less than a month.

On May 21st two workers almost plummeted into the river, but were saved by safety harnesses.

Work on the bridge is expected to resume in a few days.

Walkill, NY — A teenager who was headed to his high school prom was tragically killed after being involved in a wreck with an 18-wheeler. The fatal automobile accident occurred at Route 17 and Interstate 84, WABC.com reports.

According to officials, 17-year-old Armando Colon, a junior and honors student at Middletown High School, was traveling with three other people in his car when the accident occurred. Colon was reportedly coming off of Route 17 and was about to merge onto westbound I-84, when he came into contact with the rear wheels of a semi-truck and veered into a grassy knoll.

Police contributed the wreck to a combination of wet roads, driver inexperience and fast speeds for the road conditions.

A 19-year-old, who was the front seat passenger, sustained minor injuries. The two backseat passengers were not injured.

Colon was transported to Orange Regional Medical Center, where he was pronounced dead.

Investigations into the fatal automobile accident are underway.

The automobile accident occurred on Route 12 just before 7 a.m. on Friday, June 7, 2013, NJ.com reported.
