Dismissal of Florida smoker lawsuits against tobacco companies upheld by court

Florida – A lower court’s decision to dismiss hundreds of lawsuits against tobacco companies filed on behalf of Florida smokers and their families has been upheld by a federal appeals court. As reported by The Associated Press (AP), the 11th U.S. Circuit Court of Appeals agreed with the lower court’s decision, determining on Wednesday that the cases had been filed improperly following the death of a smoker.

Thousands of cases have been filed in Florida since the state Supreme Court threw out a class action lawsuit against cigarette makers. The lawsuit was for $145 billion.

Due to the decision, it became less difficult for sick smokers and their survivors to pursue damage claims against makers of cigarettes, diminishing restrictions regarding proof that the tobacco companies sold the products knowing of the dangers.
