Settlements in Rail Runner case approach $8 million

New Mexico – Close to a reported $8 million has been paid out in settlements for damage claims against the Rail Runner. As reported by the Associated Press (AP), the sum has been largely funded by taxpayers as opposed to New Mexico’s commuter rail service, which until last month wasn’t required to pay premiums for liability coverage under the state’s self-insurance program.

As noted in the report, $7.7 million in claim settlements has been covered by the liability fund, which is financed by taxpayers. The sum includes $4.2 million in settlements for wrongful death claims linked to car-train accidents.

An annual insurance premium was imposed on the Rail Runner in the budget year beginning last month after a review by Risk Management Director A.J. Forte.

Forte is quoted by the AP as stating of implementing the change, “We felt that it was appropriate to charge the Rail Runner premiums and not have the pool take the hit.”
