Fort Worth – A judge ordered the removal of a brain dead Texas woman from life support on Friday after a hospital kept her on life support against the wishes of her family. As reported by the Associated Press (AP), the ruling was made by Judge R. H. Wallace Jr. in the case of Marlise Munoz, who was also 14 weeks pregnant when she was found unconscious and hospitalized in November.

John Peter Smith Hospital in Fort Worth kept Munoz on life support due to her pregnancy on the basis of a state law prohibiting that a pregnant patient be removed from life sustaining treatment.

The lawsuit against the hospital is quoted as stating, “Marlise Munoz is dead, and she gave clear instructions to her husband and family — Marlise was not to remain on any type of artificial ‘life sustaining treatment’, ventilators or the like… There is no reason JPS should be allowed to continue treatment on Marlise Munoz’s dead body, and this Court should order JPS to immediately discontinue such.”
