Hooters waitress sues restaurant after reduced hours post surgery

St. Peters, Mo – A former Hooters waitress has filed a lawsuit against the restaurant chain alleging that her post surgery appearance led to her being forced to quit her job. As reported by ABC News, Sandra Lupo, 27, who worked at a Hooters in St. Peters, Mo., since 2005, took a leave from her job to have brain surgery and says her hours were reduced when she returned due to her appearance.

Lupo asserts in the lawsuit that her hours were limited after she was unable to without stress wear a wig while at work as her manager had told her to do to hide her scarring. She purports the reduced work led to her quitting and not being eligible for unemployment benefits.

A spokesman for Hooters is quoted in the report as writing in an email to ABCNews.com, “Hooters of America believes the lawsuit is without foundation, denies the accusations and has filed a motion that the lawsuit be dismissed.”
