Albuquerque, NM — The Federal Motor Carrier Safety Administration, the agency charged with preventing commercial motor vehicle-related fatalities and injuries, has reacted to the situation. The FMCSA declared that a regional emergency exists that justifies an exemption from certain safety standards. The emergency exemption has been issued because of the extreme weather conditions, shortages, and interruptions in the availability and delivery of services and property. The states affected include: Connecticut, Delaware, the District of Columbia, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Vermont, Virginia and West Virginia. The exemption became effective on October 29th and ends on the earlier of the end of the emergency situation or November 12th.

The exemption applies only to operations that are providing direct assistance to the emergency relief effort; if a driver or commercial motor vehicle is used to further commerce, the exemption does not apply. The order also does not provide an exemption from the controlled substances and alcohol use/testing requirements, the commercial driver’s license requirements, the financial responsibility (insurance) requirements, or the applicable size and weight requirements.
