Atlanta, GA — A 10-year-old boy is dead and another boy was injured after being involved in an accident with an ice cream truck in Atlanta. The fatal accident occurred around 9:15 p.m., Thursday, August 11, 2011, on Eloise Court, reported CBS News.

According to police, the 10-year-old boy and a 7-year-old boy were playing on the back of the ice cream truck when the driver asked their parents to get them off of the truck. But, the kids were on the back of the truck when the driver pulled away.

According to witnesses one of the kids fell from the truck as the driver began pulling out. The boy fell under the wheel and was run over.

The driver then began backing up to see what happened, when he hit the other boy.

Police stated that the 10-year-old boy was hit by the rear tires of the truck and died.

The 7-year-old boy was taken to an area hospital for treatment of a broken leg.

The driver is not facing any charges related to the accident.
