Allan Ziffra Wrongful Death Attorney/ 11/03/2009
Diane Elizabeth Knoop, 69, was tragically killed on October 26th on U.S. Highway 1 in South Daytona Beach, Florida, as she attempted to cross the road on her powered wheelchair. South Daytona Beach police (http://www.southdaytona.org/department/index.php?fDD=9-0) have reported that Knoop steered her wheelchair directly into the path of a vehicle being driven by Mary Louise Peless, a 58 year-old Daytona Beach resident. The accident occurred just after 1:30 in the afternoon when Peless, who was southbound on U.S. 1, was unable to stop her vehicle or otherwise avoid hitting Knoop. Peless’ vehicle pushed Knoop and her wheelchair approximately 25 feet before coming to a stop. Knoop was immediately transported to Halifax Health Medical Center (www.HalifaxHealth.org) but was unable to survive more than a few hours before she passed. Peless was not injured in the collision. Police have stated that they do not intend to file any charges against Peless because the preliminary investigation indicates that Knoop caused the accident by failing to cross the road at a designated crosswalk.
