Valero Energy Corporation sued for underpaying employees!

Texas employment law attorneys alert- Store managers of Valero Energy Corporation filed a class action lawsuit stating they were denied overtime wages.

San Antonio, TX—A Fortune 500 oil and gas refining and retail company, Valero Energy Corporation, based in San Antonio, Texas, is named in a class-action lawsuit which accuses the company of failing to pay overtime wages and underpaying convenience-store employees. The lawsuit was filed in the U.S. District Court in San Francisco on Monday, August 10, 2009, as reported by The Wall Street Journal.

The plaintiffs, two former store managers and one current store manager stated if Valero employees happened to work overtime, Valero would deduct wages from their paychecks. This was an attempt made by Valero to keep overtime down. In addition the plaintiffs, who are all women, claim they were not paid for overtime and on-call work. The three women also say they were denied meal breaks and their two 10-minute breaks, which are required by law. A Valero spokesperson released a statement on Monday stating “Based on what was in the press released issued by the plaintiff’s law firm, Valero generally denies the allegations in the lawsuit. Valero pays its employees appropriately and in accordance with state and federal laws.” The spokesperson denied to comment on any specifics of the employment lawsuit, because the company has not been served the lawsuit at this time. Attorneys representing the plaintiffs speculate the judgment for the lawsuit could reach $100 million.
