Merck appeals Vioxx drug safety suit with U.S. Supreme Court
Washington, D.C.(JusticeNewsFlash.com)–Merck & Company, one of the largest pharmaceutical companies in the world, based in Whitehouse Station, New Jersey, will argue a lower court ruling before the U.S. Supreme Court. As reported by the Wall Street Journal (WSJ), the high court agreed to hear the appeal, brought by lawyers representing the drug maker, regarding a ruling by a Philadelphia federal appellate court.
The initial lawsuit brought by attorneys, representing investors of Merck’s recalled painkiller, Vioxx, was filed in federal court accusing the drug manufacturer of misrepresenting the safety and efficacy of the pain pill. Securities fraud attorneys representing numerous investors are seeking billions in damages and are also stating company leaders misled them by manipulating clinical trial results of the recalled pain medication.
Vioxx, marketed as a non-narcotic anti-inflammatory pain medication was recalled from the U.S. market after patients were suffering from heart attacks. Numerous legal actions by product liability attorneys have been filed claiming Vioxx caused heart attacks, permanent heart damage, and even death in many patients taking the pain pill. Merck has continued to appeal the business litigation lawsuit filed by attorneys specializing in securities claims stating investors waited too long to file their legal actions. The Supreme Court will hear Merck’s appeal.
